The procedure for dismissing migrants in Russia is being updated.

Starting from March 1, in the event that territorial restrictions are introduced in Russia, it is planned to grant employers the right to terminate employment contracts concluded with foreign citizens.

According to a document obtained by TASS, the amendments being introduced to the Russian Labor Code envisage the possibility of limiting the attraction of foreign labor not only at the federal but also at the regional level. Now, decisions adopted by the authorities of the constituent entities of the Russian Federation can also serve as grounds for terminating labor relations with migrants.

As noted in the explanatory materials attached to the draft law, in 2025, the use of labor of foreign citizens working on patents will be prohibited in certain sectors of the economy in the Moscow region, Krasnodar Krai, and the Novgorod and Nizhny Novgorod regions.

Until now, employers have faced legal uncertainty: non-compliance with regional restrictions could lead to a fine of up to 1 million rubles or suspension of activities, but there was also a risk that dismissing a foreign employee would be deemed unlawful.

The proposed changes are aimed at eliminating this legal gap and aligning labor legislation with the practice of regional regulation of migration employment.
