Criminal liability is being established for the disclosure, without the court's permission, of information and details from a closed court session by a person obliged to maintain confidentiality. This was reported by the Press Service of the Ministry of Justice.
According to the additions, if grounds exist for a case to be heard in a closed court session, the court issues a ruling to hold the session in camera.
When such a ruling is issued, all participants of the session are warned about the prohibition of disclosing information without the court's permission. A signed statement is also obtained from them agreeing not to disclose it.
The draft indicates that if these obligations are violated, liability is envisaged in accordance with Article 239 of the Criminal Code (disclosure of preliminary investigation or inquiry data).
The sanctions of this article provide for a fine of up to fifty times the base calculation amount, or corrective labor for up to three years, or restriction of liberty for one to three years, or imprisonment for up to three years.
